A hold deposit agreement records that a buyer has paid to reserve a specific animal for a set period, how the deposit applies to the price, and whether it comes back if the sale does not happen. The hold

  1. The seller will hold the animal named above for the customer for ______ days from the date of this agreement, until ______________ (date).
  2. The deposit is applied to the purchase price when the sale is completed.
  3. The balance is due on or before the last day of the hold.

If the sale does not go ahead (tick one)

  1. ☐ The deposit is refundable in full if the customer withdraws before the hold ends.
  2. ☐ The deposit is refundable less $ ______ if the customer withdraws before the hold ends.
  3. ☐ The deposit is not refundable if the customer withdraws, except as stated below.
  4. If the animal becomes unavailable for any reason on the seller's side, the deposit is refunded in full.
  5. If the hold ends without the balance being paid, the hold lapses, the animal may be offered to others, and the deposit is handled as ticked above.

Many states require pet dealers to give buyers specific written disclosures and set minimum buyer protections. Check your state's current rules and add any required wording before you use this.

Record the deposit on the animal's file so a second deposit is never taken on the same animal by accident.
